2. Purposes of data processing and data retention periods

MulDia will process the information provided by the owner of the data (hereinafter referred to indistinctly as «user», «interested party» and/or «customer») through the different channels provided in accordance with the following purposes:

– To manage and attend to users’ queries through the website. The user’s data will be kept for this purpose until the user opposes or revokes their consent.

– To guarantee the quality of our services by recording telephone calls made to MulDia.

– To manage the recruitment process for MulDia. The user’s data will remain active in the MulDia candidate database for 3 years after the user has provided it to MulDia.

– To manage business relations with customers who have entered into or are in the process of entering into a business relationship with MulDia. The processing of this personal data will be carried out for the purposes of administrative and accounting management, the execution of a contract or the application of pre-contractual measures.

– To promote our products among our customers and those who have given their consent to receive commercial communications.

– To carry out the Surveillance service, managing the identification, quantification, evaluation and prevention of the risks of the use of the products marketed, as well as the monitoring of any incidents that may occur. The data provided by the user will be retained for the time necessary to ensure compliance with the legal obligations that correspond to MulDia.

3. Legitimation of the processing

The legitimacy of the treatment to manage and respond to queries through web forms, is the express consent of the interested parties.

With regard to telephone recordings, the processing of data will be carried out on the basis of MulDia legitimate interest in ensuring the quality of its services.

When you provide us your curriculum vitae as part of a recruitment process, your data will be processed on the basis of the implementation of pre-contractual measures and the execution of a contract.

With regard to Surveillance, the legal basis for the processing of data is compliance with the legal obligations in this area. As regards the legitimacy of the processing of customer data, the lawful basis for the processing of data is the performance of a contract or the implementation of pre-contractual measures.

If you have purchased any of the products offered by MulDia, we inform you that we may process your personal data to send you commercial information about products similar to those purchased. Such processing would be carried out on the basis of the legitimate interest of the entity in promoting products similar to those previously purchased. The sending of commercial communications may also be carried out on the basis of express consent.

4. Categories of personal data for the purposes of Surveillance

Surveillance legislation requires that we collect accurate and verifiable information on each reported potential incident, which allows the potential incident to be tracked, evaluated and recorded with other incidents on the same product. The personal data that can be recorded are:

– Identification data: name, e-mail, telephone number.

– Personal characteristics data: sex, age.

– Specially protected data (health): product used, incident.

– Other data: batch number of the product.

In the event that the source of the surveillance data does not come from the person concerned, MulDia may collect the following data:

– Name, contact details, membership of the health professional group and relationship to the person concerned.

5. Category of recipients and international transfers

Personal data is not disclosed to third parties, unless legally obliged to do so. No international transfers of personal data are made either.

6. Rights of the interested party

The rights that the user can exercise are:

– To revoke the consents granted.

– Obtain confirmation as to whether or not MulDia is processing personal data concerning the user.

– Access their personal data.

– Rectify inaccurate or incomplete data.

– Request the deletion of their data when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

– Obtain from MulDia the limitation of data processing when any of the conditions provided for in the data protection regulations are met.

– To request the portability of their data.

– Not to be subject to automated individual decisions.

However, we inform you that you have the right to lodge a complaint with the Spanish Data Protection Agency if you consider that a breach of data protection legislation has been committed with regard to the processing of your personal data.

MulDia adopts the security levels required by the European Data Protection Regulation appropriate to the category of data that are processed at all times.

MulDia treats the user’s data at all times with absolute confidentiality and keeping the mandatory duty of secrecy regarding them, in accordance with the provisions of the applicable regulations, adopting the necessary technical and organizational measures to ensure the security of your data and avoid its alteration, loss, treatment or unauthorized access, given the state of technology, the nature of the data stored and the risks to which they are exposed.

9. Minors

Persons under 18 years of age may not use the services available on the MulDia website without the prior authorization of their parents, guardians or legal representatives. Therefore, the latter will be solely responsible for the acts carried out through our website of minors in their care, including the completion of any form with the personal data of these minors and the marking of any box that accompanies it.
